YOU SEE, THE US CONSTITUTION STATES THAT ONE CANNOT CREATE A NEW STATE FROM THE TERRITORY OF ANOTHER STATE.
Washington DC IS ACTUALLY PART OF THE STATE OF MARYLAND. LEGALLY MARYLAND NEVER SIGNED OVER ITS TERRITORY TO THE FEDERAL
GOVERNMENT
The Federal Government administers the district, in the same way that it administers an Army base in Texas.
That Army Base in Texas cannot be turned into a state either. It is still on Texas Land. Those who live on base, are not denied the vote or representation. They vote as residents of Texas.
The “District of Columbia” is administered by agreement as a Federal District. That’s why the “DC” in its name, but it never was legally severed from the State of Maryland. It originally also was supposed to be in part of Virginia but Virginia refused.
The push for statehood claims that DC residents need representation in Congress. And they should have representation, voting representation as citizens of the state of Maryland But to declare DC a State would violate the US Constitution prohibition on creating a new State from the territory of an existing state. And would make about as much sense as declaring Fort Bragg to be a new state.
Seriously, if you want to seek out violations of Article 4 Section 3 of the US Constitution, take a look at the creation of West Virginia. It was created by splitting off land from Virginia while Virginia was in rebellion and part of the Confederate States of America.
Not if the CSA was considered legal, West Virginia could be created under Article 4. But the Union, under Lincoln did not recognize Virginia as separate from the Union so they did create a state from part of another state? Did they violate the Constitution? So much time has passed, I suppose it does not matter anymore, but what happened should not be allowed to be precedent for the creation of a Washington DC State.
BUT WHAT IF WE DECIDED TO USE WEST VIRGINIA AS PRECEDENT FOR INTERPRETING ARTICLE 4, SECTION 3 THE WAY THE DEMOCRATS WANT TO SEE WASHINGTON DC AS A WAY FOR CITIZENS TO NOT BE DENIUED REPRESENTATION IN THE SENATE.
Then that would open up other changes.
Southern Illinois might feel denied representation because of Cook County (Chicago).
California could split, providing those not in LA and San Francisco Senate representation they cully feel denied by California politics.
New York could split, as many feel they are denied fair treatment because of the domination of New York City.
So, maybe the Democrats are opening a proverbial Pandora’s Box, because to gain two Senators in Washington DC for the Democrats, may mean creating 3-4 more states, and 6-8 more Senate seats for Conservatives.
